Client Rules & Responsibilities

Last updated: June 20, 2026

These rules apply to all clients who engage Exquisite Estate and Appraisal, LLC for appraisal, estate sale, or mobile notary services in Brevard County and Central Florida. By booking an appointment or service with us, you agree to the responsibilities described below. They exist so that every engagement is conducted lawfully, safely, and to the highest professional standard.

General Client Responsibilities

  • You confirm that you are the owner of the property and items involved, or that you have the legal authority and any required consent to engage our services on the owner's behalf (for example, as an executor, personal representative, trustee, or holder of power of attorney).
  • You agree to provide accurate, complete, and truthful information about the property, items, and documents involved in the engagement.
  • You are responsible for arranging safe and lawful access to the property, including any keys, gate or lockbox codes, parking, and entry instructions.
  • You agree to disclose any known hazards or conditions at the property (for example, structural issues, pests, mold, firearms, hazardous materials, or aggressive animals) before our arrival.

HOA, Condominium & Community Association Rules

Many properties in Brevard County and Central Florida are governed by a homeowners association (HOA), condominium association, or similar community association. You are solely responsible for advising us, in advance, of any such rules and regulations that may affect our services, including but not limited to:

  • Permitted hours of operation, noise restrictions, and rules limiting the days or times an estate sale or service may take place.
  • Rules regarding signage, advertising, flyers, and directional signs on or around the property.
  • Parking restrictions, guest parking, gate access, and traffic or crowd limitations.
  • Any required notice to, or approval from, the association, as well as any applicable permits or fees.

You agree to obtain any necessary association approvals or permits and to advise us of all applicable restrictions before the engagement begins. Exquisite Estate and Appraisal, LLC is not responsible for any fines, penalties, or violations resulting from association rules that were not disclosed to us.

Compliance with Florida Laws, Rules & Guidelines

Our services are provided in accordance with applicable Florida laws, rules, and guidelines governing appraisals, estate sales, and notary services. You are responsible for ensuring that the work you ask us to perform is lawful and that you have the legal right to have it performed, including compliance with any probate, tax, licensing, permitting, or sales-tax requirements that apply to your situation.

Appraisal Services

  • You agree to provide honest and accurate information regarding the ownership, history, provenance, and condition of items submitted for appraisal.
  • You understand that an appraisal is a professional opinion of value prepared in good faith and in accordance with applicable Florida law and recognized appraisal standards, and is not a guarantee of sale price or future value.
  • You are responsible for safeguarding original documents and for any decisions you make based on the appraisal, including tax, insurance, estate, or legal matters.

Estate Sale Services

  • You confirm you have the legal authority to sell or dispose of all items offered for sale and that no items are subject to a dispute, lien, or claim by another party.
  • You are responsible for removing, securing, or clearly marking any items that are not for sale before the sale begins.
  • You are responsible for advising us of, and complying with, all HOA and community rules, local ordinances, permitting requirements, and applicable Florida law relating to estate and tag sales.
  • Sales tax will be collected and remitted where required by Florida law. You agree to disclose any items that may require special handling or licensing to sell.

Mobile Notary Services

  • Each signer must appear in person, be conscious and willing, and present valid, government-issued photo identification as required by Florida notary law.
  • Documents must be complete, with no blank spaces, before notarization. The notary cannot provide legal advice, draft documents, or advise on which documents you should sign.
  • You are responsible for ensuring the document is appropriate for your needs and for confirming any signing or recording requirements imposed by the receiving party, institution, or applicable Florida law.
  • Any required witnesses are the responsibility of the client unless arranged with us in advance.

Liability

To the fullest extent permitted by Florida law and any applicable Brevard County ordinances, Exquisite Estate and Appraisal, LLC and its representatives are not liable for any loss, damage, fine, penalty, or claim arising from inaccurate information, undisclosed HOA or community rules, lack of authority, or the client's failure to comply with applicable laws and regulations. You agree to hold Exquisite Estate and Appraisal, LLC harmless from any such claims to the extent permitted by law.
